1. Introduction & Acceptance of Terms

Welcome to My Smart Teach. These Terms and Conditions ("Terms") govern your use of the website located at mysmartteach.com (the "Site") and your participation in our pilot program. The Site is a copyrighted work belonging to Unique Tech Solution ("Company," "us," "our," and "we").

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree with all of the provisions of these Terms, do not access or use the Site.

2. The Service We Provide

My Smart Teach provides an AI-powered platform (the "Service") designed to act as an assistive tool for educators. The Service includes, but is not limited to, tools for preparing educational materials, assessing student work, and analyzing performance data. The features and functionality available are subject to change, particularly during the pilot program phase.

3. The Pilot Program

By signing up for our pilot program, you agree to participate as a "Founding Member." This is a pre-commercial launch program designed for us to gather feedback and improve the Service.

Access: We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for the duration of the pilot program for feedback and evaluation purposes only.
Feedback: You agree to provide honest and timely feedback regarding your experience with the Service when requested. You grant us a perpetual, worldwide, royalty-free license to use this feedback for any purpose, including the improvement of the Service.
Future Fees: You acknowledge that the pilot program is a temporary, pre-release program and that access to the Service will require a paid subscription upon its full commercial launch. Participants in the pilot program may be offered a promotional discount on future subscription fees, at our sole discretion.

4. Intellectual Property Rights

Our Intellectual Property: The Site and the Service, including its "look and feel," all underlying technology (including our UK patent-pending "Reflective Consensus" technology), and all content, demos, videos, and apps created by us, are the exclusive property of Unique Tech Solution. You agree not to copy, modify, distribute, or reverse-engineer any part of the Site or Service.
Your Intellectual Property: You (or your school) retain full ownership of all the content you upload to the Service, including class rosters, rubrics, and student submissions ("User Content"). We claim no ownership rights over your User Content. You grant us a limited, royalty-free license to use your User Content solely for the purpose of providing and improving the Service to you.

5. User Accounts & Responsibilities

When you create an account to use the Service, you agree to provide accurate and complete information, keep your password confidential, and be solely responsible for all activities that occur under your account.

6. Acceptable Use Policy

You agree not to use the Site or Service to upload or transmit any content that is unlawful, harmful, or infringes on the rights of others, or to attempt to gain unauthorized access to our systems.

7. Disclaimer of Warranties & Limitation of Liability

The Site and Service are provided on an "as-is" and "as-available" basis. We make no warranties that the Service will be uninterrupted, error-free, or completely accurate. The AI-powered features provide suggestions and are not infallible.

To the maximum extent permitted by UK law, Unique Tech Solution shall not be liable for any damages resulting from your use of the Service. You acknowledge that My Smart Teach is an assistive tool. The user, as the qualified educator, is solely responsible for reviewing, verifying, and approving all final grades and feedback provided to students.

8. Privacy and Data

Your use of the Site and Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Termination

We may suspend or terminate your access to the Site or the pilot program at any time, without notice, for any reason, including for any breach of these Terms.
